Frequently Asked Conveyancing Questions

Below are a range of common questions that we get asked about our conveyancing services. If you have any further questions please contact us using our contact us page or drop past our office at 733 Sturt Street, Ballarat.

What is conveyancing?

Conveyancing is the legal transfer of ownership of property between parties. While conveyancing is known for the transfer of ownership, it also covers a range of areas including advice, document preparation, attending settlement on your behalf, property research and liaising with appropriate parties and financial institutions. You can read more about conveyancing at Consumer Affairs Victoria.

How much does the service cost?

There are many variables to consider with any conveyancing work. For this reason we suggest that you contact us, let us know what you are after and we will provide you with a quote. We provide a range of fixed cost services to ensure your peace of mind.

Do I need a conveyancer or a solicitor?

Both a conveyancer and a solicitor can act on behalf of a client to organise the legal transfer of property. Solicitors offer a variety of legal services. A conveyancer is specialised in the area of conveyancing and are experts in property transfers. Although they are not essential when transferring property, it is highly recommended to use a professional, such as a conveyancer.

A conveyancer will apply their expertise to handle the quite complicated, time consuming and confusing details of property transfers. Conveyancers will avoid incorrectly submitted documents which can lead to settlement delays, excess fees and possibly causing contracts to be rescinded.

What if I need to reschedule my appointment?

We understand that from time to time things happen which will mean you won't be able to make the appointment. If this happens, please give us a call on 03 5331 1416 or email us at info@switchconvey.com.au as soon as you can to reschedule.

How long does a contract of sale take to create?

Contract of sales can take anywhere from a few hours to several weeks to create. Common factors that affect this time frame include:
  • Are you able to provide all the information and documents we need straight away?
  • Are there multiple property owners?
  • Are there non standard contract of sale conditions?

It's always best to contact us as soon as you know you require a conveyancer. This ensures that your service gets completed as quickly as possible.

What is Stamp Duty?

Stamp Duty (also known as Land Transfer Duty) is the fee put in place by the State Government. It's normally paid by the purchaser of the property within 30 days after settlement.

This fee will vary depending on the purchase price of the property and any applied concessions from the State Revenue Office such as the First Home Owner Grant.

You can get an estimate of how much this Stamp Duty fee will be by using the online calculator which can be found on the State Revenue Office website. This is an estimate for transfer fees within Victoria only. If you are outside Victoria you'll need to contact the appropriate authority for an estimate.

For extra information please don't hesitate to contact us on 5331 1416.

"We had bad experiences with our last 2 Ballarat Conveyancers, so didn't hold out a lot of hope. But we were pleasantly surprised by the professional and modern way our requirements were dealt with — particularly because, as we live interstate, it was difficult with our needs and movements.

We found the staff to be very flexible, accommodating, and co-operative - which made this transaction hassle-free and enjoyable. There is a simple test for testimonials — would we use you again? We do have another property to sell, and we intend to return to Switch for this one.

Well done - thanks for making this painless."
